Can the parties themselves submit requests to the cadastre?
From November 4th 2023, parties do not have the possibility to personally submit a request for the registration of some immovable property, right, note or pre-note, but now, only professional users can submit it on their behalf. Professional users are lawyers who have concluded a contract with the Republic Geodetic Institute, as well as registered geodetic organizations. Requests are submitted exclusively through the specialized information system E-counter, which is located on the website of the Republic Geodetic Institute.
Which requests are submitted by lawyers, and which by geodetic organizations?
Lawyers submit the following requests: obtaining a list of real estate, changing the owner of rights to real estate, conversion of rights, registration and cancellation of mortgage, registration of JMBG, correction of errors, etc. Geodetic organizations submit requests: for merging plots, dividing plots, changes resulting from the construction and extension of the building, determining, changing or canceling the house number, etc.
Who are obliged to submit the request ex officio?
Obligors to submit requests ex officio are: courts, public notaries, public bailiffs and public administration bodies and other bodies and organizations that, in the exercise of public powers, make decisions that are the basis for registration in the real estate cadastre. The most common example from practice when a request for change is submitted ex officio is when a public notary does so after the solemnization of the real estate transaction contract.
