It is the strictest such measure; the milder ones are a summons, being brought before the court, a ban on approaching, meeting or communicating with a specified person and on visiting specified places, a ban on leaving one&rsquo;s place of residence, bail, and house arrest. Detention should therefore be distinguished from serving a prison sentence: detention is a measure applied during the proceedings, while serving a prison sentence is the execution of a penalty imposed by a final judgment.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>What are the conditions for ordering detention?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Detention may be ordered against a person reasonably suspected of having committed a criminal offence if:<\/p>&#13;\n\r\n<ul class=\"wp-block-list\">&#13;\n<li>they are in hiding, or their identity cannot be established, or as a defendant they are clearly avoiding appearing at the main hearing, or other circumstances indicate a risk of flight<\/li>&#13;\n\r\n\r\n&#13;\n<li>there are circumstances indicating that they will destroy, conceal, alter or falsify evidence or traces of the offence, or where particular circumstances indicate that they will obstruct the proceedings by influencing witnesses, accomplices or accessories after the fact<\/li>&#13;\n\r\n\r\n&#13;\n<li>particular circumstances indicate that within a short period they will repeat the offence, complete an attempted offence, or commit an offence they have threatened<\/li>&#13;\n\r\n\r\n&#13;\n<li>the offence charged carries a prescribed prison sentence of more than ten years, or more than five years for an offence with elements of violence, or a first-instance judgment has imposed on them a prison sentence of five years or more, and the manner of commission or the gravity of the consequences of the offence have caused public disquiet capable of jeopardising the unhindered and fair conduct of the criminal proceedings<\/li>&#13;\n<\/ul>\r\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Who decides on detention?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Detention is decided exclusively by the court, on a motion by the public prosecutor, and after the indictment has been confirmed also ex officio.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Is detention mandatory in certain cases?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Odgovor je: ne. Pritvor je uvek fakultativna mera.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>How long can detention last?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">A defendant may be held in detention for a maximum of three months from the day of deprivation of liberty; the immediately higher court may, however, for important reasons and on a reasoned motion by the public prosecutor, extend detention by up to a further three months. If no indictment is brought once those time limits expire, the defendant is released. After the indictment is filed with the court, detention may last indefinitely, that is, until the defendant is sent to serve a prison sentence.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Is time spent in detention counted towards the prison sentence?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">The answer is yes, it is counted.
